Family of 5-year-old killed in Houston crash suing accused drunk driver

HOUSTON, Texas (KTRK) — The family of 5-year-old Caleb Posadas is filing a lawsuit against suspected drunk driver Sebastian Matta.

The crash happened Sunday, April 11, while Caleb and his dad, Luis Posadas, were on their way home from a 2-year-old’s birthday party. At the intersection of Fountain View and the northbound feeder road of the Southwest Freeway, Matta reportedly ran through a stoplight and slammed into the Nissan that Luis and Caleb were in. The impact of the crash caused the Nissan to roll over. Both Caleb and his dad were taken to a hospital where Caleb was pronounced dead.

Matta is charged with driving while intoxicated. Now, Caleb’s family is seeking damages for his death, as well as for the injuries Luis and a witness sustained from the crash.

“(Caleb) will be sorely missed by his parents who are now deprived the opportunity to watch their son grow up,” a statement from the family’s attorney read.

The family’s attorney added that Matta may not be the only person responsible for Caleb’s death and are investigating why Matta was on the road intoxicated.

“Unfortunately, (Luis) last memories of his child are trying to do CPR on his child, seeing that (Caleb) was severely injured and the blood coming from his mouth, having trouble breathing,” said the family’s attorney Lena Laurenzo.
