Was a murder charge warranted in alleged car thief’s death? Texas legal expert weighs in

Dushawn Caples faces a murder charge following allegations that he pursued and shot an individual who stole his car. His attorney asserts that it is a case of self-defense.

According to authorities, Caples was at home when he heard his vehicle being stolen. He purportedly armed himself, entered his wife’s car, and pursued the thief. Despite commands to stop, the driver, accompanied by a passenger, continued driving. Allegedly, Caples fired shots at the stolen car.

The incident culminated in a crash on Golden Eagle Drive around 4 a.m. Saturday, resulting in the death of 17-year-old Danell Cotton from gunshot wounds. Another individual was observed fleeing the scene with a backpack.

Initially, law enforcement considered it a potential case of road rage. Caples’ wife contacted 911 to report the stolen vehicle, and authorities pieced together the sequence of events.

Sandra Guerra Thompson, a professor at the University of Houston Law Center, outlined the rights individuals have concerning property protection.

Texas is unique in allowing the use of deadly force for property defense. However, Thompson noted that certain circumstances could lead to charges. Allegedly, Caples tampered with evidence and did not report the shooting to 911.

While property protection is safeguarded by law, it is not a justification for lethal force. Nevertheless, Texans are legally protected if they reasonably believe no other method can recover their property.

In similar instances, Thompson highlighted that familiarity with the thief’s identity and alternative recovery methods could impact legal proceedings.

An investigation is ongoing, and the case will be presented to a grand jury for consideration. Ultimately, the District Attorney’s Office, the grand jury, and potential trial jurors will determine the outcome.
