Houston developer ignores multiple violations and builds dozens of homes without a single permit

In Shepherd Forest, a neighborhood where homeowners typically need permits for renovations, residents are baffled by a developer’s ability to continue construction on a commercial site without any permits.

Sherry Evanicky, a long-time homeowner in the area, expressed frustration over the lack of progress in addressing the issue. The property in question, situated between the 610 Loop and Oak Forest Drive, has seen extensive construction work, including concrete slabs and large mounds of dirt, despite numerous red tag notices from the City of Houston lining the perimeter.

Developer Scott Lichtenberg has been involved in the project since 2022, with proposed plans ranging from 70 townhomes to apartment units. However, no plans have been approved, leaving the community uncertain about the project’s details. Despite lacking permits, Lichtenberg has proceeded with construction, resulting in multiple fines and citations for violations such as absence of permitting and failure to obtain necessary permits from the Texas Commission on Environmental Quality (TCEQ).

The Shepherd Forest Civic Club has been vocal in requesting the developer to comply with permitting regulations, but their appeals have gone unanswered. While aware of the situation, City Council Member Abbie Kamin, Houston Public Works, and The City of Houston Legal Department have yet to take decisive action.

Neighbors feel frustrated by the lack of legal recourse available to them, particularly as they are not a homeowners’ association with the financial resources to pursue legal action. Despite the mounting concerns, Lichtenberg has remained elusive, responding dismissively to inquiries about the development.

The community’s disappointment is compounded by the uncertainty surrounding the project’s adherence to safety and regulatory standards. As Lichtenberg’s trial date approaches in May, residents hope for a resolution that prioritizes their safety and well-being.
